Questions as to what should happen to the matrimonial home, how other assets should be divided, should a pension fund be taken into consideration and is maintenance due to be paid to my spouse as well as the children, are common. Parties must first try to resolve matters via ‘mediation’, unless there is a good reason not to do so. If a mutually agreed settlement can be reached we can then draft a Consent Order which details the agreement made. Both parties sign the document and it is sent to the Court where it is then signed by a Judge.

Where agreement cannot be reached between parties by mediation then a formal application to the court for ‘financial remedy’ (previously known as ‘ancillary relief’) may be necessary. This ‘financial remedy’ is where a court hearing will decide the issues.

One example of what we can achieve was a recent case on a financial settlement of approximately £700,000 where we also advised on contested proceedings under the Children Act and subsequent related issues.

The case involved a co-ordinated approach across a number of our Thursfields’ teams, including corporate (advising on the termination of the wife’s position in the company, the use of company bank accounts and the sale of shares), wills and estates (advising on wills, severing a joint tenancy and inheritance tax) and property (advising on the sale of the former matrimonial home and purchase of a property suitable for residential and commercial use).

Throughout the case, enormous pressure was exerted from the other side as they enjoyed the benefit of wealthy parental support.  This had affected our client’s health and led them to consider withdrawing from the case.The support provided by our experienced team inspired our client to continue with the case and the result was that he kept the business, and obtained a clean break order.
