RICS Electronic Communications Code Seminar

John McLean of our Birmingham Office delivered a successful seminar to RICS members in Birmingham last week.

The new Electronic Communications Code was implemented on 28 December 2017.  Landowners should take note if they are currently negotiating with telecoms operators for the installation of electronic communications equipment on their land, or are considering doing so in the near future.  Any template agreements or leases that have previously been used will need to be amended to be fit for purpose for future use under the new Code.

John spoke on the various changes brought into force under the new Code, including changes to assignment, upgrading and sharing, security of tenure, and valuations.

Feedback on the seminar was very positive.  Comments included:

“Helpful and balanced overview of the provisions of the new ECC – clear and precise summary of a complex set of provisions.  Thank you!”

“This was a new topic for me.  It gave me a good insight into the topic and awareness of rights and obligations associated with this equipment”.
