Family law experts at Thursfields Solicitors are offering free, half-hour consultations to new customers throughout the month of June to celebrate the company’s expansion into modern offices at Halesowen.

Solicitors Jasdeep Nagra and Pam Arrowsmith, who both specialise in divorce, financial matters, children and disputes with cohabitating partners, said the complimentary 30-minutes could enable unhappy couples to consider the forthcoming new route of ‘no-fault’ divorces.

Pam and Jasdeep explained how current divorce laws in England and Wales require one spouse to blame the other for the marriage breaking down, which can cause a lot of anger and disagreement.

Pam said: “Fortunately, the requirement to prove adultery, unreasonable behaviour, desertion or a period of separation will soon be abolished.”

She said this followed the landmark case of Owen v Owens in 2018 focussed attention on this issue, where the wife had to stay in a loveless marriage until she could prove she had been separated from her husband for two years (with his consent) or five years (without his consent).

This led the government to confirm in April that it will introduce new legislation whereby the couple or one spouse would only need to notify the court that their marriage has irretrievably broken down, removing the ability for one person to contest a divorce.

Jasdeep said: “This will reduce conflict between the separating couple and give them time to focus on the financial matters arising from the divorce, and to discuss arrangements surrounding their children.”

Under the new legislation, the government will introduce a minimum timeframe of six months from the petition to the Decree Absolute, reducing the backlog at divorce centres across the country.

Jasdeep added: “The introduction of the no-fault divorce is long overdue, removing blame and simplifying the process and I along with most lawyers will welcome the change.”
