For many people, January means a new start, New Years resolutions and a time to reassess life… Family law

For many people January means a new start, New Years resolutions and a time to reassess life.  Naturally this will often mean an assessment of existing relationships and the future. Inevitably, for some, this will mean a decision to separate and to divorce.

Many will have heard of the term “divorce day” in the press, this being the first working day after the Christmas period which is heralded as the ‘busiest day of the year’ for divorce lawyers who, it is said, can expect to receive a spike in new enquiries from people seeking advice on divorce and separation following the festive period. Whilst it is often said that the “stress” of the Christmas period, spending more time with a spouses relatives, a frank exchange of views after too much alcohol, even receiving disappointing gifts, the reality is that many people will have made the decision to deal with their situations in the New Year.

We have found that for most people who seek divorce and separation advice in January, their relationships have already reached a crisis point where one, if not both parties have decided that it cannot continue. Relate suggests that one in five people in the UK are in what is called a “distressed relationship” and the statistic that 42% of all marriages end in divorce is certainly indicative of this.  January is a common time for people to take steps to address these changes in their lives.

It is important for people who have made the decision to separate from a spouse to seek support and legal advice as early as possible.
